Terms of Consent - Canada

Please review these terms of use for participating in our SmartParent text-message prenatal and parenting education program.

By enrolling in SmartParent you:

1. Agree and consent to receive text messages from SmartParent.

2. Acknowledge the right to discontinue your enrollment in SmartParent at any time without giving a reason and without any negative impact on you. You can discontinue receiving text messages from SmartParent by texting “STOP” to the sender (12323) or by cancelling via the website portal.

3. Accept that SmartParent will not provide you with any personalized medical advice with regard to your individual or your child’s individual circumstances and/or your or your child’s medical condition.

4. Accept that, although SmartParent will not charge you to sign up or to receive the text messages, standard message and data rates may apply. This means that you may be charged by your mobile phone service provider (e.g., Bell, Rogers, Telus, etc.) for receiving/sending SmartParent text messages and/or browsing links included in the text messages, depending on the type of phone plan you are currently on.

5. Acknowledge that only SmartParent and our technology provider, Memotext, will have access to your data.

6. Confirm that you have had the opportunity to ask questions and have had your questions answered to your satisfaction.

Personal Information

Personal information is information we hold which is identifiable as being about you.

Our collection, use, and disclosure of your personal information is regulated by the Personal Information Protection and Electronic Documents Act (Canada), or similar privacy legislation applicable in your Province, as amended from time to time. You can find more information about your privacy rights at the Office of the Privacy Commissioner of Canada (OPC).

We collect information from you when you enroll in the program including:

· Your cell phone number

· First three digits of your postal code

· Pregnancy due date

· Your baby’s birth date

Your data are held by SmartParent and by our technology vendor, Memotext. Data are stored on secure servers located in Canada and in password-protected files. Your confidentiality is respected at all times: no information that discloses your identity will be published or shared with anyone. Information collected in the surveys includes:

Our messages contain links to other websites. Although we regularly check our links, those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of linked websites.

Security

While no service is completely secure, we take all reasonable measures to protect information about you against unauthorized access, use, alteration, or destruction.

Requesting access or correcting your personal information

Subject to applicable local laws and regulations, you may have some or all the following rights with respect to your personal data:

· to request access to your personal data and to rectify any inaccuracies within that personal data;

· to request the erasure of your personal data residing with us;

· to withdraw your consent to our processing of your personal data.

If you wish to contact us to with a request relating to personal information we hold about you, please contact us using the contact details set out below including your name and contact details. We may need to verify your identity before providing you with your personal information. We will deal with all requests for access to personal information within a reasonable timeframe.
